Certified e-mail CEM The e-mail that has legal value

CEM stands for Certified Electronic Mail.

CEM is a computerized communication system, similar to standard electronic mail, with additional security and certification features, such as making the electronic transmission valid for legal purposes and opposable to third parties (Presidential Decree 11 February 2005, No.68). The sender is, in fact, provided with electronic documentation certifying the sending and delivery of an e-mail message.

What makes the CEM transmission valid for legal purposes are the electronic receipts that the CEM Managers issue, “certifying”:

• the sending of a message by the sender;
• the delivery of the message to the recipient’s email address;
• the time and date of sending.

The sending and delivery receipts that the sender receives from the Managers are legally valid. The computerised tracing of the operations carried out, retained by law for a period of 30 months, allows reproduction, with the same legal value, of those receipts.

If communication takes place between two email addresses that both use a certified email service, then the CEM transmission has the same value as a registered letter with return receipt.
